"Датский прецедент" в решении вопроса о праве Российской Федерации на недвижимость бывшего СССР.

Значение активности российского государства в защите своих прав на недвижимое имущество, доставшееся ему в наследство от бывшего СССР, явственно прослеживается при изучении опыта судебных разбирательств, споров относительно регистрации прав России на недвижимость, проходящих в зарубежных судах.

“THE DANISH PRECEDENT” IN THE ISSUE OF THE RIGHT OF THE RUSSIAN FEDERATION TO THE PROPERTY OF THE FORMER USSR

The paper analyzes the issue whether the recognition of the state as legal successor to the state that ceased to exist is the legal foundation to recognize the former as the owner of the property of the latter on the strength of the successor's pledge to service the predecessor's liabilities. The issue is examined on the basis of the real action in rem heard at all court levels of Denmark that the Ukraine brought against the ruling of the cadastral court concerning the property of the former USSRin Denmark.
