Техническое регулирование в странах ЕЭП.

Настоящая статья посвящена проблеме разработки и использования единых технических регламентов России, Беларуси и Казахстана как базового элемента развития интеграционных процессов внутри стран Таможенного союза (далее – ТС), а также вопросам установления единых обязательных требований к продукции в них. Развитие единой системы технического регулирования ТС – это первостепенная задача, решение которой является необходимым условием для обеспечения свободного движения товаров, устранения технических барьеров в торговле, упрощения работы бизнеса, расширения международного сотрудничества участников ТС. При вступлении технических регламентов в силу обязательные требования, установленные на национальном уровне, отменяются, что имеет определяющее значение для снижения технических барьеров в торговле и создания эффективного единого рынка на территории ТС и Единого экономического пространства (далее – ЕЭП). Система принятия единых обязательных требований и совершенствования связанных с их применением инструментов стандартизации, аккредитации и обеспечения единства измерений аналогична наилучшей международной практике, принципам и правилам, действующим в ЕС.
Помимо разработки и принятия единых технических регламентов по направлению «Техническое регулирование» в статье рассмотрены другие совместные проекты Беларуси, Казахстана и России – это разработка межгосударственных стандартов, которая в настоящее время является приоритетным направлением работ по стандартизации для участников ТС, в результате применения которых на добровольной основе обеспечивается соблюдение требований технических регламентов. Важными элементами формируемой системы технического регулирования являются также государственный контроль (надзор), ответственность, аккредитация органов по сертификации и испытательных лабораторий (центров), обеспечение единства измерений.
В статье уделяется внимание проблемам развития единой системы технического регулирования, а также рассмотрены основные направления ее совершенствования: проведение гармонизации внутренних стандартов; необходимость приведения сферы аккредитации органов по оценке соответствия и испытательных лабораторий к международным стандартам; внедрение системы взаимного признания результатов оценки соответствия товаров.

TECHNICAL REGULATIONS IN CES COUNTRIES.

The present paper is dedicated to the issue of developing and applying  uniform technical regulations of Russia, Belarus and Kazakhstan as the base element of the integration processes in the Customs Union (further – CU) countries, and to the issue of  establishing the uniform obligatory requirements to the production. Development of the uniform system of technical regulations of the CU is the task of prime importance. Finding solution to this issue can become the condition for free movement of goods, elimination of technical barriers in trade, business work simplifications, expansion of the international cooperation of participants in the CU. Upon the technical regulations becoming effective the national obligatory requirements are cancelled, which is of paramount importance for eliminating technical barriers in trade and setting up an effective uniform market in the CU and the Common Economic Space (further – CES). The system of the uniform obligatory requirements and improvement of the tools of standardization incidental to the application, accreditations and provision of  unity of measurements is similar to the best international practices, the principles and the rules existing in the EU. In 2014 in the CU 34 technical regulations were adopted, the 24 of them came into force, covering the goods of the paramount value in the society, so-called, basic goods. In addition to the development and adoption of the uniform technical regulations the article considers another co-project of Belarus, Kazakhstan and Russia – the development of interstate standards - that at present is of  paramount importance for standardization for participants of the CU. Their application on a voluntary base provides the observance of technical regulations. Other main elements of technical regulation system are state control (supervision), responsibility, accreditation of certification bodies and test laboratories (centers), provision of measurements unity to which uniform approaches aimed at raising efficiency of the CU’s technical regulation are under formation at present. The article considers the problems of development of the uniform system of the technical regulation and the main directions of its improvement: harmonization of internal standards; compliance of accreditation bodies and test laboratories with the international standards; mutual recognition of the goods conformity assessments.
