CONSTITUTIONAL REGULATION OF THE HUMAN RIGHTS AND FREEDOMS IN SWEDEN

The paper provides an overview of the fundamental human rights and freedoms contained in the Swedish constitutional acts such as the Instrument of Government (1974), the Freedom of the Press Act (1949) and the Basic Law on the Freedom of Expression (1991). The main international agreements and conventions related to the human rights and freedoms ratified by Sweden are also covered.

Since some of the constitutional provisions stipulating the rights and freedoms are quite controversial, the paper describes different points of view on such provisions of wellknown Swedish law researchers and experts.

The classifications of the constitutional rights and freedoms given in the article are the ones that are commonly used in both Swedish and Scandinavian legal doctrines.

The distinctive feature of the Swedish constitutional acts is the emphasis put on the techniques and possibilities for limiting the powers of ordinary legislation. Therefore the paper thoroughly describes the rules of how and when the fundamental rights and freedoms may or may not be restricted and to which extent they also apply to foreign citizens.
